Terms of Service

1. Acceptance

By using Breakalytix ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Description of service

Breakalytix is an independent collectible-card sourcing and resale-record tool. It may use AI vision to identify individual cards or cards visible in lot photographs and may use available market information to assist with purchase decisions. It is not affiliated with card manufacturers, grading companies, marketplaces, leagues, athletes, schools, or teams. See our Disclaimer for full details.

3. Free tier and scan limits

Scan credits are non-transferable and have no cash value. Paid plans are planned for a future release; this document will be updated when they launch.

4. Acceptable use

You agree not to:

• Use the Service to facilitate fraud, misrepresentation, or illegal activity.
• Reverse-engineer, scrape, or systematically extract data from the Service.
• Share account credentials or circumvent scan limits.
• Upload images you do not have the right to submit for analysis.

5. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind. AI identifications, market valuations, BUY / MAYBE / PASS results, max-buy amounts, tax reserves, and profit projections are estimates for informational purposes only. We do not guarantee card identity, condition, authenticity, grade, value, demand, sale price, or profit. See our full disclaimer.

6. User decisions; no professional advice or gambling

Breakalytix does not provide financial, investment, tax, accounting, or legal advice. It does not facilitate gambling, wagering, betting, sweepstakes, or games of chance. You are responsible for verifying cards, comparable sales, costs, taxes, and all buying and selling decisions.

7. Limitation of liability

To the maximum extent permitted by law, Breakalytix's total liability for any claim is limited to the amount you paid in the 12 months preceding the claim, or $10 USD, whichever is greater.

8. Data and account

Guest tracker information is temporary and is not intended to persist between visits. Signed-in sourcing and tracker records may be cached on the device and synced to our cloud database under the signed-in account. You can download available exports or backups from the Service. See our Privacy Policy for data practices and deletion requests.

9. Changes to terms

We may update these Terms at any time. Continued use after changes are posted constitutes acceptance. Material changes will be communicated via in-app notice.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
